BorderBird

Terms of Service

Last updated: October 18, 2026

1. Service description

BorderBird is a rental-management and record-keeping tool for landlords to track rent, expenses, and tax remittances. BorderBird is not an accountant or tax advisor and does not provide accounting, tax, or legal advice. Reports, calculations, and remittance suggestions are provided for convenience only. You are responsible for verifying all data, calculations, and forms before filing with the CRA, IRS, or any other tax authority.

2. Acceptable use

You agree to use BorderBird only for lawful property management and tax record-keeping purposes. You may not attempt to access other users' data, reverse engineer the service, or use it to facilitate illegal activity (including tax evasion).

3. No warranty on tax accuracy

BorderBird is provided "as is." We make no warranty that calculations, FX rates, remittance amounts, or generated reports are accurate or complete. You bear sole responsibility for the accuracy of your tax filings.

4. Limitation of liability

To the maximum extent permitted by applicable law, BorderBird and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, missed tax deadlines, CRA or IRS penalties, or data loss — arising out of or in connection with your use of the service. Our total aggregate liability to you for any claim shall not exceed the greater of (a) the fees you paid to BorderBird in the twelve months preceding the claim, or (b) CAD $50. Some jurisdictions do not allow these limitations; in those cases liability is limited to the minimum amount permitted by law.

5. User data ownership

You own all property, tenant, payment, and expense data you upload to BorderBird. You may export or delete it at any time. We will not sell or rent your data to third parties. See the Privacy Policy for details on how data is stored and used.

6. Termination and data retention on deletion

You may close your account at any time. When you do, we permanently delete your login and anonymize the personal information that identifies you — names, emails, phone numbers, and non-resident (NR) account numbers — promptly and within 30 days. Anonymized financial-ledger records (rent received, expenses, owner disbursements, and CRA/IRS remittance entries) are retained after deletion — no longer linked to any identifiable person — to meet Canadian tax and accounting record-keeping obligations (generally six years) and because the ledger is an append-only record that cannot be altered. See the Privacy Policy for details. We may suspend or terminate accounts that violate these terms or attempt to abuse the service.

7. Refunds and cancellation

Paid plans are sold by BorderBird Technologies LLC. The short version of this section is on our Refund Policy page.

  • Cancel anytime. When you cancel a paid plan, you keep access until the end of the period you have already paid for. You are not charged again after that.
  • Monthly plans. Monthly fees are not refunded or prorated for a partial month.
  • Free trials. A free trial lasts 30 days and needs a card on file. You can extend it once, by two months, in Settings → Subscription before it ends. If you do not cancel before the trial ends, your card is charged for the plan you chose on its last day: day 30, or the new end date if you extended it. We email you a reminder about 7 days before that first charge.
  • Annual plans. Paid plans are billed monthly. If annual plans are offered in future, an annual plan will be fully refundable if you ask within 14 days of its first charge.
  • Other refunds. We also refund where the law requires it, and when we charged you in error.
  • How to cancel. In the app, go to Settings → Subscription and choose Cancel subscription. You can also email admin@borderbird.com from the address on your account.

8. Changes to these terms

We may update these terms from time to time. When we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of BorderBird after the effective date constitutes acceptance of the updated terms.

9. Governing law

These terms are between you and BorderBird Technologies LLC and are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Lee County, Florida.
